GROSS BUSTERS BIN CLEANING SERVICE AGREEMENT
This agreement, delineating the terms and conditions governing the utilization of the bin cleaning services provided by Gross Busters LLC (hereinafter referred to as “Gross Busters”), is entered into between the undersigned individual (hereinafter referred to as “Customer” or “you”) and Gross Busters.
1. Agreement Overview:
This document, along with any supplementary documents, including operating rules, policies, and price schedules expressly referenced herein and published by Gross Busters from time to time, collectively constitutes the “Agreement.” By availing yourself of the service provided by Gross Busters, you affirm your acceptance of and consent to be bound by the terms of this Agreement.
2. Service Description:
Gross Busters provides bin cleaning services accessible through its website at www.Gross-Busters.com or by phone at 219.888.0900. The service encompasses the cleaning of trash cans, recycling bins, and yard/organic waste bins, offered on a weekly, biweekly, monthly, bimonthly, subscription, or one-time basis. Subscription plans automatically renew until canceled by the customer, with cancellations to be submitted in writing via email to [email protected] or through text messaging to 219.888.0900.
Service notifications are delivered via text messaging to the mobile phone number provided by the customer upon acknowledging this service agreement, limited exclusively to periodic service-related updates. Gross Busters adheres to strict privacy standards and commits not to disclose customer information except as mandated by law.
3. Customer Responsibilities:
To ensure the provision of optimal service, customers are obligated to adhere to the following conditions:
• Ensure trash cans are emptied prior to scheduled cleaning, with residual waste acceptable within reasonable limits.
• Position trash cans curbside and easily accessible until 9 pm on the designated service day.
• Ensure bins are free of human or animal waste, cooking/motor oils, chemicals, fresh paint, adhesives, hazardous waste, and grass clippings.
• Only bins tagged by Gross Busters are eligible for service, with tags to remain intact and not transferred.
4. Gross Busters Responsibilities:
In the event of service failure not attributable to customer negligence, Gross Busters will compensate the customer at its discretion, either by extending the service subscription or rescheduling the missed service.
5. Modifications to Agreement and Service:
Gross Busters reserves the right to amend this Agreement, with any modifications communicated through revised versions posted on www.Gross-Busters.com or via email to the address provided by the customer. Service schedule modifications may occur to enhance operational efficiency, with efforts made to accommodate specific customer requests.
6. Charges and Payment:
Customers agree to remit payment for services rendered at the prevailing rates applicable to their service area. Pricing adjustments or additional charges will be communicated via www.gross-busters.com, with notifications sent to current customers via text message or email. Payment is due in accordance with the designated payment cycle and must be made via credit card, debit card, or automatic bank transfer as selected by the customer. Payments are processed before or at the time of service.
7. Cancellation and Refund Policy:
All service fees paid in advance are non-refundable, except in cases of proven relocation to an area not serviced by Gross Busters. Customers may cancel recurring charges after fulfilling the minimum service duration corresponding to their selected service frequency.
Minimum Services Per Subscription
* Weekly Service – 8 Cleanings
* BiWeekly Service – 12 Cleanings
* Monthly Service – 6 Cleanings
* BiMonthly Service – 6 Cleanings
8. Miscellaneous:
Neither party’s failure to enforce its rights under this Agreement at any time shall constitute a waiver of such rights. If any provision of this Agreement is deemed illegal or unenforceable, the validity and enforceability of the remaining provisions shall remain unaffected. The Agreement supersedes all prior representations, negotiations, or understandings between the parties.
Neither party shall be liable for failure to perform its obligations under this Agreement due to circumstances beyond its reasonable control. If such failure persists for at least 30 days, the unaffected party may terminate the Agreement by written notice.
